What to Expect from DWI/DUI Charges

If you have been charged with a first-time DUI or DWI, you will be facing two separate processes that follow. One is the criminal legal process in which you will have to go to court to enter a plea and answer to the charges filed against you. Unless you have been involved in an accident in which someone was injured or there was property damage, you will probably be facing a misdemeanor.

Our firm can investigate and examine the following to build your defense:

  • Police or accident reports
  • Witness testimony
  • Chemical test results
  • The legality of your traffic stop

Our main goal is to find inconsistencies and flaws in the prosecutor's case. From there, we can negotiate with the prosecutor to get the charges against you reduced or dismissed or present your legal defense before the judge in a bench trial.

The other proceeding is the DMV hearing, which is a civil administrative process, where it is determined whether or not you will lose your license in a suspension. We can represent you at this hearing as well to fight to keep your driving privileges. If you have been given a breath test at the time of your arrest, you will have seven days from the date of your arrest to request this hearing or else your license will automatically be suspended.
