Track Palin Arrested for Domestic Violence

Track Palin, son of 2008 vice-presidential candidate Sarah Palin, was arrested in Alaska this week for various domestic violence related offenses. Palin was reportedly intoxicated at the time of the offense. Police responded to a 911 call, and arrested Palin for Assault, Interference with a Domestic Violence Report and Misconduct Involving a Weapon. Police reported that Palin was drunk and in possession of a firearm at the time of the offenses. While this offense occurred in Alaska, similar conduct in Nevada would likely have resulted in very serious charges. Nevada is well known as an “open carry” state and for its permissive gun laws. However, a combination of firearms and alcohol can have terrible results, as appears to be the case in Track’s situation.

An arrest or conviction for Battery Domestic Violence can have serious consequences for an accused. If police in Nevada respond to a domestic violence call and have probable cause to believe that a battery occurred, then they are required to make an arrest (absent extraordinary circumstances). A conviction for Battery Domestic Violence can result in mandatory jail time, huge fines, and loss of the Second Amendment right to own or possess firearms. In addition, it is unlawful in Nevada for a person to be in possession of a firearm while under the influence of drugs or alcohol. A person who violates this provision is guilty of a misdemeanor and can be punished by up to six (6) months in jail.

It is unclear from the information available what conduct might have occurred to result in a charge of “Interference with a Domestic Violence Report.” In Nevada, if someone prevents a person from calling the police, that person is often charged with Coercion. If the act is done by force or threat of immediate force, the offense is a felony and is punishable by up to six (6) years in prison and/or a $5,000.00 fine.
