What are the penalties for marijuana in Nevada?

Even just one ounce of marijuana in your possession could result in prison time and thousands in fines. Take a look at the following penalties below:

Possession of Less Than One Ounce

  • First offense: up to $600 in fines and a drug treatment program
  • Second offense: up to $1,000 in fines and a drug treatment program
  • Third offense: up to $2,000 in fines and/or 1 year in jail
  • Fourth offense: up to $5,000 in fines and/or 4 years in prison

Manufacture, Trafficking and Sale

  • 1 ounce to 100 pounds: up to $20,000 in fines and 1-15 years in prison
  • 100 to 2,000 pounds: up to $25,000 in fines and 5 years in prison
  • 2,000 to 10,000 pounds: up to $50,000 in fines and 2-20 years in prison
  • 10,000+ pounds: up to $200,000 in fines and 5 years to life in prison

There are other additional penalties that can be applied for selling marijuana to a minor or selling it within a school zone. Even having drug paraphernalia associated with marijuana use could land you with harsh penalties.

It should be noted that going to more than one doctor to get multiple prescriptions is called doctor shopping, and that is prescription fraud. If you get a prescription, then you will need to put into the state's registry. You will get an identification card that lists one primary caregiver, a non-physician who is at least 18 and helps you with medical treatment. You are also legally allowed to cultivate up to 12 mature cannabis plants for medical marijuana. You can possess up to 2.5 ounces for medical use. If a dispensary is within 25 miles from where you live, then you may have further limits on what you can cultivate.

What is a medical necessity defense?

Essentially, this means proving that the medical use of marijuana was necessary to avoid serious physical harm, even if it technically broke the law. It may be possible to prove that you believed you would suffer serious physical harm unless you used medical marijuana, that the threat to your health was enough to justify its use.
