Sexual Assault Charges in Las Vegas

Las Vegas Sexual Assault Attorney

Sexual assault is one of the most serious crimes that a person may be accused of committing. This sex crime is most often referred to as rape but is specifically referred to as sexual assault under Nevada law. Depending on the age of the victim versus the age of the alleged offender, the nature of the act and a number of other factors, a defendant may face life in prison without the possibility of parole. A conviction of this kind may also have a significant influence on all areas of the defendant's life, even when he or she is released from prison. It may affect personal relationships, employment and even housing, financial and educational opportunities. Because mandatory sex offender registration will be required, the defendant will also face being labeled as a sex offender for the rest of his or her life.

Considering the dramatic impact that a criminal conviction or even rape allegations may have on you and your family, it is important to move quickly and retain the services of a Las Vegas criminal defense lawyer if you or someone you know has been accused of sexual assault. When you work with the Brown Law Offices, you will experience the benefit of having a former chief prosecutor on your side. Attorney Phil Brown spent more than 14 years as a Chief Deputy District Attorney for Clark County and can use this unique experience to build a stronger and more effective defense against sexual assault charges. He knows how the other side works and can use this to his clients' advantage.

Penalties for Sexual Assault in Nevada

Following is a brief outline of the potential penalties for sexual assault (repeat offenders will face enhanced penalties):

  • If the victim is 16 or older and sustains substantial bodily harm – life in prison without the possibility of parole, or life in prison with the possibility of parole after 15 years.
  • If the victim is 16 or older and does not sustain substantial bodily harm – life in prison with the possibility of parole after 10 years.
  • If the victim is 15 or younger and sustains substantial bodily harm – life in prison without the possibility of parole.
  • If the victim is 14 or 15 and does not sustain substantial bodily harm – life in prison with the possibility of parole after 25 years.
  • If the victim is 13 or younger and does not sustain substantial bodily harm – life in prison with the possibility of parole after 35 years.

Nevada Revised Statutes Chapter 200, Section 366 (NRS 200.366) defines sexual assault and the penalties that may be enforced upon a defendant convicted of this crime. The general definition of sexual assault is forced or non-consensual sexual intercourse with another person. It may be committed against the will of the victim or in a situation where the victim was mentally or physically disabled and the offender knew or should have reasonably known of the disability or incapacity.
