Understanding Prostitution & Solicitation Offenses
Prostitution is the crime of engaging in sexual acts for money. It can also include the trading of goods for sex. A plea bargain can sometimes occur with first-time offenders involving the payment of a fine, community service and completing an AIDs awareness class.
Prostitution is a misdemeanor offense punishable by:
- Probation
- Up to 6 months in jail
- Up to $1,000 in fines
- Community service
Law enforcement will often organize sting operations in which a police officer possess as a "john" (a prostitute's customer) to trick prostitutes into asking for money for a sexual favor. The evidence in a prostitution case can include an officer seeing the exchange of money, hearing the prostitute soliciting the john, or finding large amounts of money, a client book or condoms on the prostitute.
There are several other crimes that are associated with prostitution. It is not uncommon for the police to lack sufficient evidence to charge someone with prostitution; therefore, they will search for something else to charge them with. These "other" offenses may include trespassing (as in entering a casino after you have been told to leave), loitering (outside a business or in public for no specific reason), using a false ID (as in a casino or bar for example), or providing false information, or if someone is a minor in a gambling establishment, he or she can be charged with underage gambling. Most of these crimes are categorized as misdemeanor offenses with penalties involving up to six months in jail and/or up to $1,000 in fines.

Solicitation is the offering or money for sexual favors. The sex act does not have to take place for a person to be charged with this crime. Police officers will often pose as prostitutes to entice solicitation. The penalties for solicitation are similar to prostitution -up to six months in jail and a maximum of $1,000 in fines. First-time offenders can be ordered to pay a fine and attend First Offender Prostitution School (John School) as part of a plea bargain for case dismissal or lesser charges.
